Refund policy

Purchases made by accessing the site lagiardinieradimorgan.com are also regulated by the legislation of the Consumer Code (Legislative Decree no. 206/2005), and specifically by the provisions of Chapter I of Title III of Part III of the aforementioned legislation, such purchases are therefore also protected by the Withdrawal Policy as indicated in the General Terms and Conditions of Sale.

You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within 14 (fourteen) days from the day of delivery of the purchased Product.

In the event of purchase of a Gift Card, the right to withdraw can be exercised within 14 (fourteen) days from the purchase of the same, after verification by the Seller of the non-use of the Gift Card by the recipient. To withdraw from the contract you need to fill in the appropriate online form or send an email to ordini@lagiardinieradimorgan.com indicating the order number you want to make, email address, a telephone number that will be used by customer service in case of need. Telephone numbers will NOT be used for advertising purposes. You will need to specify on which product you want to exercise the right of withdrawal and, if you deem it appropriate, the reason for the return (this information helps us to provide a better service). The exercise of the right of withdrawal will be confirmed with an email sent to the address provided by you at the time of sending the order; in this message you will find the necessary information to proceed with the return of the products for which you have exercised the right of withdrawal.

The right of withdrawal is in any case subject to the following conditions:

1. The right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased.

2. The right applies to the purchased product that is intact, including the outer packaging and/or the casing containing the purchased product.

3. The shipping costs relating to the return of the goods shall be borne by the customer.

4. The delivery of returned goods is under the responsibility of the customer until the certified receipt is at our warehouse.

5. The Seller is in no way liable for damage or theft/loss of goods returned with uninsured shipments.

6. In the event of damage to the goods during transport, the Seller shall notify the Customer of the incident (within 5 working days of receipt of the goods in its warehouses), to allow them to file a complaint against the courier chosen and obtain a refund of the value of the goods if insured. In this case, the product will be made available to the customer for its return at the same time cancelling the withdrawal request.

The right of withdrawal totally lapses, due to the lack of the essential condition of integrity of the asset (packaging and/or its content), in cases where it is ascertained:

a. The lack of the outer packaging and/or the casing containing the purchased product;

b. Damage to the product caused by the delivery of the same by the Seller.

In the event of forfeiture of the right of withdrawal, the Seller shall return the purchased goods to the sender, charging the same for shipping costs.

The Right of Withdrawal – in addition to compliance with the terms and methods described above – is intended to be exercised correctly if the following conditions are also fully respected:

– the right of withdrawal is exercised correctly and sent to the Seller within 14 (fourteen) days from the date on which the purchased Product was delivered, or for Gift Cards within 14 (fourteen) days from the purchase provided that the same has not already been used by the recipient.

If the Right of Withdrawal is exercised following the methods and terms indicated, the Seller shall reimburse any sums already collected for the purchase of the products per the methods and terms provided.

The amounts will be refunded to you as soon as possible and, in any case, within 14 (fourteen) days from the date on which the Seller became aware of the exercise of your right of withdrawal, it will activate the refund procedures, once verified the correct execution of the terms and conditions indicated above, as indicated in paragraph 5 of the General Terms and Conditions of Sale, which we invite you to read carefully.

If the terms and conditions for exercising your right of withdrawal are not respected, you will not be entitled to reimbursement of the amounts already paid to the Seller. For a more detailed description please refer to the Terms and Conditions.
